  1. Each visitor is required to submit this form and to agree with the Liability Waiver .
  2. Parents/Guardians should submit one form per child (visitor) and for themselves.
  3. This contract is legally binding.
  4. Submitting this form does not grant you entrance into the property. All visitors must acquire permission from the owners prior to entry for each day of visit.

Agreement
Waiver and Release of Liability

This Waiver and Release of Liability (“Agreement”) is entered into by and between the owners of the farm located at 957 Yellow Gate Rd, York, South Carolina (“Owners”), and the undersigned visitor (“Visitor”).

1. ACKNOWLEDGMENT AND ASSUMPTION OF RISK
The Visitor acknowledges and understands that visiting the farm involves activities conducted on rural land, including but not limited to, interaction with animals, outdoor activities, and exploring natural and agricultural environments. The Visitor acknowledges that these activities carry inherent risks of injury, including but not limited to, accidents, falls, bites, and exposure to allergens.

The Visitor voluntarily assumes all risks associated with their visit to the farm, including any injury, illness, damage, or loss that may result. The Visitor acknowledges that outdoor spaces might present rustic, rugged, and weathered elements, including splinters, rust, holes, spikes, dead branches, machinery, and other things common to forests, farms, and rural areas, and therefore voluntarily assumes all risks associated with their presence in this environment.

2. RELEASE OF LIABILITY
In consideration of being allowed to visit the farm, the Visitor hereby releases, waives, discharges, and covenants not to sue the Owners, their officers, directors, employees, agents, contractors, volunteers, and affiliates (collectively, the “Releasees”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Visitor, whether caused by the negligence of the Releasees or otherwise, while on the farm property or in any activity related thereto.

3. INDEMNIFICATION
The Visitor agrees to indemnify, defend, and hold harmless the Releasees from and against any and all claims, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to their visit to the farm, including any claims brought by third parties.

4. MEDICAL TREATMENT
The Visitor consents to the administration of first aid and other medical treatment in the event of injury or illness and releases and indemnifies the Releasees from any and all liability or claims arising out of such treatment.

5. VEHICLES AND BELONGINGS
The Visitor acknowledges that the Owners are not liable for any damage to vehicles or belongings, including theft, while on farm grounds. Visitors are recommended to use heavy-duty off-road vehicles to avoid potential issues.

6. RULES AND REGULATIONS
The Visitor agrees to abide by all rules and regulations established by the Owners. The Visitor acknowledges that the Owners reserve the right to remove any Visitor from the property for failure to comply with the rules and regulations or for any behavior deemed inappropriate or unsafe.

7. PHOTO AND MEDIA RELEASE
The Visitor grants permission for the Owners to take photographs and videos during activities and to use such media for promotional, educational, and other purposes without compensation.

8. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of South Carolina. Any disputes arising out of or related to this Agreement shall be resolved exclusively in the state or federal courts located in York County, South Carolina.

9. SEVERABILITY
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

10. VISITORS’ INDEMNIFICATION
The Visitor agrees that any guests they bring to the farm, including family members or friends, shall be subject to the same indemnification terms. The Visitor, along with any of their guests, indemnifies, defends, and holds harmless the Releasees from and against any and all claims, liabilities, damages, costs, and expenses (including attorneys’ fees) arising out of or related to their visit to the farm, including any claims brought by third parties. If the Visitor is signing on behalf of a minor or another adult, they assume all liability on behalf of that minor or adult.

11. USE OF FIREFIGHTING EQUIPMENT AND FIRST AID KITS
Authorized visitors are free to use the firefighting equipment and first aid kits available on the property. However, visitors assume all responsibility for checking expiration dates and ensuring they know how to use the resources properly. The Owners are not responsible for maintaining or offering firefighting or first aid kits, but make them available as a courtesy. It is up to the visitor to determine if they need to use these resources and to use them correctly, ensuring that the products have not passed their expiration dates and are used properly and according to the laws of the State of South Carolina.

12. INDIVIDUAL FORMS FOR VISITORS
Each adult visitor must fill out a form for themselves. A parent or guardian should fill out a form for each of their children.

13. VALIDITY AND PERMISSION
This contract is valid for an unlimited time or until the Owners voluntarily decide to cancel it. This contract does not grant visitors permission to enter the property without direct authorization of the Owners for each given day.

14. SUPERVISION OF MINORS
Visitors agree to supervise their underage guests at all times, ensuring their safety and adherence to farm rules and guidelines.

15. PROPERTY MAINTENANCE
Visitors acknowledge that the farm is not professionally maintained and that some parts may not be properly maintained.

16. DAMAGES
Visitors agree to be financially responsible for any damages they or their dependents cause to the property, including but not limited to structures, equipment, and natural elements.

17. DIGITAL SIGNATURE AND INFORMATION COLLECTION
This contract will be served online. Visitors accept to sign it digitally by submitting the form. Visitors also agree that the Owners can collect and store their information, including IP address, email, phone number, and other information provided on the form. The The Visitor agrees to be contacted through the e-mail and phone number provided. While the Owners will not sell or distribute this information, they will not be held liable in the event of data theft.

18. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties and supersedes any prior or contemporaneous understandings, representations, or agreements, whether written or oral.
